Terms of Use

1. Agreement

By creating an account, signing in (including with Apple or Google) or otherwise using the Services, you agree to these Terms and to the processing of your information as described in the Privacy Policy. If you do not agree, do not use the Services. References to “Exeriva”, “we”, “us” and “our” mean the operator of the Services.

2. Eligibility and your account

You must be at least 13 years old, and old enough to consent to these Terms where you live. You are responsible for the accuracy of the information you provide, for keeping your sign-in credentials secure, and for activity under your account. Tell us promptly at support@exeriva.com if you believe your account has been accessed without your permission.

3. Health and fitness information

Exeriva is a general wellness tool. It is not a medical device and does not provide medical advice, diagnosis or treatment. Nutrition estimates, targets, training plans, medication reminders and other figures are for information only. Consult a qualified professional before starting a new diet, exercise programme or medication, and stop any activity that causes pain or discomfort. Never rely on the Services in an emergency.

4. Automated and assisted features

Some features, including AI Cam, Voice and AI Coach, use automated processing to recognise food, interpret what you say or type, and answer questions about information you have recorded. To provide these features, the content you submit to them is processed by our selected services, as described in section 4 of the Privacy Policy. By agreeing to these Terms you consent to that processing whenever you use one of these features. The features are optional, and nothing is sent unless you use them.

Automated results can be incomplete or wrong. Review every suggestion before saving it; nothing is added to your records until you confirm it.

5. Coaches

The Services let you connect with coaches. Coaches are independent of Exeriva and are responsible for their own guidance. You choose what a coach can see, and you can end the connection at any time.

6. Acceptable use

You agree not to misuse the Services, including by: accessing another person’s account or data without permission; interfering with, overloading or probing the Services; scraping them or reverse-engineering them except where the law allows; using automated features to generate unlawful, harmful or abusive content; or using the Services in breach of any law.

7. Your content

You keep ownership of what you add to the Services, such as meals, photos, notes and messages. You give us a limited licence to store, process and display that content only as needed to operate the Services for you and as described in the Privacy Policy.

8. Ending your use

You can stop using the Services and delete your account at any time from Settings. We may suspend or close an account that breaches these Terms or puts the Services or other users at risk. Sections 3, 7, 9 and 10 survive the end of your use.

9. Disclaimers and limitation of liability

The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, and we are not liable for indirect, incidental, special or consequential damages, or for loss of data or profits. Nothing in these Terms limits liability that cannot be limited under applicable law, including your rights as a consumer.

10. Apple

If you use the iOS app, these Terms are between you and Exeriva, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for any product claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with the App Store Terms of Service.

11. Changes

We may update these Terms. When a change is material we will tell you in the app or by email before it takes effect. Continuing to use the Services after that means you accept the updated Terms.
